1. Acceptance of Terms

By creating an account on TitionersHub ("Platform"), you ("Practitioner") agree to be bound by these Terms of Service and our Privacy Policy and Data Processing Agreement. If you do not agree, do not use the Platform.

TitionersHub is operated by Luan Els, trading as TitionersHub, a South African sole proprietor.

2. Description of Service

TitionersHub is a cloud-based practice management platform for physiotherapists, biokineticists, personal trainers and rehabilitation specialists. It includes patient record management, scheduling, exercise prescription, invoicing, AI assistance and calendar sync.

3. Account Registration

You agree to provide accurate information, keep your password confidential, notify us of any unauthorised access, and be responsible for all activity under your account. You must be a registered healthcare or fitness professional to create a Practitioner account.

4. Subscription and Payment

SoloR499/month — 1 practitioner, unlimited patients, all core features
ClinicR999/month — up to 5 practitioners, floor booking and AI Co-pilot
GroupR1,799/month — unlimited practitioners, all features plus priority support

Free trial

New accounts receive a 14-day free trial with no credit card required. A paid plan is required to continue after the trial.

Payment and cancellation

Payments are processed monthly via Paystack in South African Rand. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds for partial months.

5. Acceptable Use

You agree not to enter false patient information, violate any applicable law including POPIA and HPCSA guidelines, infringe third-party rights, attempt unauthorised access, reverse engineer the platform, or share your credentials with others.

6. Patient Data and POPIA Compliance

Your responsibilities

As Practitioner, you are the "responsible party" under POPIA for patient data you enter. You are responsible for obtaining explicit patient consent, ensuring data accuracy, complying with POPIA, and registering as an Information Officer with the Information Regulator.

Our responsibilities

TitionersHub acts as "operator" under POPIA, processing patient data only on your instructions. We implement appropriate security measures, retain patient records for a minimum of 5 years, and do not share patient data with third parties except as described in our Privacy Policy. Our full obligations are set out in the Data Processing Agreement which forms part of these Terms.

7. Intellectual Property

The Platform is owned by TitionersHub and protected by intellectual property laws. You are granted a limited, non-exclusive licence to use the Platform for practice management purposes. You retain ownership of all patient data and clinical content you enter.

8. Availability and Uptime

We aim to maintain 99% monthly availability excluding scheduled maintenance. We are not liable for losses arising from Platform unavailability.

9. Limitation of Liability

To the maximum extent permitted by South African law, TitionersHub is not liable for indirect, incidental or consequential damages, loss of revenue or data, clinical decisions made using the Platform, or third-party service failures. Our total liability shall not exceed the amount you paid us in the three months preceding the claim.

10. Clinical Disclaimer

TitionersHub is a practice management tool only. The AI Co-pilot and other features assist practitioners and do not constitute medical advice. All clinical decisions remain the sole responsibility of the registered Practitioner.

11. Termination

We may suspend or terminate your account for breach of these Terms, non-payment, or as required by law. On termination, you may request a data export within 30 days. Data is retained in accordance with our retention policy.

12. Governing Law

These Terms are governed by the laws of South Africa. Disputes are subject to the exclusive jurisdiction of the South African courts.

13. Changes to Terms

We will notify you of material changes by email at least 14 days before they take effect. Continued use constitutes acceptance.
